Student Handout 3. 1 – The Difference Between Civil Law and Criminal Law When is a legal problem criminal and when is it civil? What difference does it make whether it is criminal or civil? One way of looking at criminal law is that it is dealing with something of public interest. For example, the public has an interest in seeing that people are protected from being robbed or assaulted. Criminal law involves punishing and rehabilitating offenders, and protecting society. Since the public has an interest in having criminal law, we give the government the power to put it in place and enforce it. The police and Crown Prosecutors are hired by the government to put the criminal law into effect. Public funds are used to pay for these services. If you are the victim of a crime, you report it to the police and they have the responsibility to investigate. They arrest and charge the suspect. In most cases, if a charge has been properly laid and if there is evidence supporting it, the Crown Prosecutor, not the person who complains of the incident, prosecutes it in the courts. This is called a system of public prosecutions. Long ago the person who had been wronged prosecuted the case. The power to prosecute privately remains, but is used rarely now. Even if a person starts a prosecution privately, the Attorney General has the power to take over the prosecution of the case. As a victim, you do not have to be responsible for enforcing the law. The police and Crown Prosecutor do their jobs for the public at large, not for you personally. In a criminal case, the Crown prosecutor must prove the defendant’s guilt â€Å"beyond a reasonable doubt. † This means that at the end of a trial the judge or jury can only find the defendant guilty if they are left without a reasonable doubt about the defendant’s guilt. In other words, there is no logical or rational reason to doubt the defendant’s guilt. This is not the case in civil law. Civil law is about private disputes etween individuals or between individuals and organizations. Civil matters include areas such as contract law, family law, tort law, property law and labour law. The person suing for a wrong has the burden of proving their case on a â€Å"balance of probabilities. † This means that a judge or jury must believe their story and evidence more than the defendant’s version. They do not need to be convinced beyond a reasonable doubt . Civil disputes usually involve some harm, loss or injury to one party or their property. Unlike criminal law; however, civil law is primarily involved with compensating victims. If a civil action is successful, the defendant will be responsible for the wrongful action. While a defendant in a criminal case may be found â€Å"guilty† or â€Å"not guilty,† a defendant in a civil case is said to be â€Å"liable† or â€Å"not liable† for damages. If you have a civil law problem, you have to take action yourself if you want to get a legal remedy. You can hire a private lawyer, and you will have to pay the expenses of pursuing the matter. For example, if you hire someone to paint your house and they do a poor job, it is a dispute between you and the painter. The police do not get involved. If you want to sue the painter for breach of contract, it is your responsibility to do so. What if the story was twisted so that the play wasn't a tragedy and actually turned into a love story due to Ophelia? This is how I would have written it if I were William Shakespeare. Ophelia who was Hamlet's love in the play would have recognized the reason for Hamlet's madness, taken the situation in to her own hands in order to stay with Hamlet, and would have solved all the problems that makes this play a tragedy. When Hamlet first realizes who has killed his father he starts to plan his revenge. In the beginning of the play Ophelia recognizes that Hamlet is having problems and forms an opinion, which hints to hamlet being mad or insane. She doesn't really pay attention to Hamlet's real needs and purpose for being upset. What should have happened is. Hamlet would of let Ophelia know the truth about Claudius so that Ophelia would have a better understanding of where Hamlet is coming from. By recognizing this first, many problems in the original tragedy wouldn't have taken place. With Ophelia aware of the murderer, she takes matters into her own hands due to her love for Hamlet. Secretly she kills Claudius, but the cause for his death is unknown. Hamlet is the only person besides Ophelia who knows who the culprit is. This is kept a secret between the two and their love is what keeps the secret from getting out. All the little tragedies within the original tragedy are what make it such a great tragedy, but if I were to make this into a love story these wouldn't be necessary. By eliminating Claudius secretly. Hamlet's revenge is no longer necessary. Hamlet does not end up killing Polonius in his mother's quarters. Ophelia has no reason to go insane, Laertes seeks no revenge on Hamlet, and Claudius is not there to help get rid of Hamlet. Without all of these situations in the play Hamlet becomes king and is able to give his love to the people of his kingdom, and Ophelia. Hamlet and Ophelia are not King and Queen and the King Hamlet, the Ghost, is content with the present. These events are what make it a love story instead of tragedy and everyone lives happily ever after. I chose Ophelia to be the reason why Hamlet is still alive because all the other characters are recognized more often in the play, and I feel that Ophelia would be the person least suspected for the murder of Claudius. Education Essays - Educational Research, More Than Twenty Years Education I am one of these people they generally refer to as a "mature student". It is too bad that this term doesn't mean what suggests, that I study in a more mature way than people who have not been out of school as long as I have. It simply means that I have not been in a formal classroom for quite a while in my case for more than twenty years. There are advantages and disadvantages to having this gap in one's education. One advantage is that it does give me some perspective to see that education has undergone some changes since those long ago years when I was in school. Two of these changes in curriculum and a change in teachers. The attitude to class meterial is a lot more flexible now than when I was in school. I remember thtat in high school history cource which I took there was only one textbook and that was to be memorized. Anything outside the book was "off topic", and we had to get back to learning "the facts" because that was what the exam was going to be about. In the history class which I am taking now we don't even have aaa book. The teacher brings in material from many souces magazines, newspaper, journals and government publications. The final exam is no longer the most important thing. It is the papers we write and our participation in class which is impoertant. Curriculum has certainly changed a great deal over twenty years. Another change which I have noted is the change in teachers. Teachers today seem much more approachable than twenty years ago. Today's teachers dress in a more casual and relaxed way. They don'tt drop dead in their tracks if you call them by their first name. Most important, they seem to have actually admitted that they didn't know the answer to a question which a student asked. They often say, however, that they know where thay cand find the answer. This willingness to be a learner alonng with the students is new to me. Teachers today are frequently partners in the learning process. The teacher of twenty years ago was more interested in maintaining his authority.
